DIVERSE EXPERIENCE

David’s experience encompasses all aspects of IP law with a particular focus on domestic and foreign patent procurement, patent portfolio management, M&A due diligence, freedom-to-operate studies, and opinions of counsel. David also has extensive IP litigation experience including litigation in the federal district courts, the International Trade Commission (ITC), and in post-grant proceedings at the United States Patent and Trademark Office.


While David has a mechanical background, he has helped clients obtain and protect intellectual property within a variety of technologies ranging from the mechanical to the high-tech. Such technologies include orthopedic devices, heart valves and pumps, aircraft engines and structures, agricultural equipment and products, firearm components and accessories, semiconductor packaging, IoT devices and systems, and robotic surgical and diagnostic platforms.

PRAGMATIC STRATEGIZING

David believes that an IP strategy should build a good offense and strong defense that is congruent with a client’s unique business characteristics. On the offensive side of the equation, David leverages his experience in patent prosecution and litigation to obtain enforceable IP rights that are robust against validity challenges and that seek to maximize potential damages or royalties. In doing so, David considers various factors unique to a particular client’s market situation, such as geographic reach, supply chains, competitive landscape, and the like. When it comes to defense, David has extensive experience identifying and analyzing risks posed by competitor IP rights as they relate to clients’ commercial endeavors and deploying strategies to mitigate such risks.

LEADERSHIP AND CORE VALUES

While attending The Ohio State University, David served an enlistment in the United States Marine Corps Reserve as an infantryman in 3rd Battalion, 25th Marine Regiment. In 2005, his battalion was deployed to Al Anbar Province, Iraq where he participated as a non-commissioned officer in several major combat operations including daily counterinsurgency patrols and IED sweeps. David lives by the Marine Corps’ core values of honor, courage, and commitment.
